The Supreme Court Re-Establishes the Boundaries Between the Branches of Government
It is time Congress does its job.
The recent Supreme Court Rulings, Biden v. Texas, West Virginia v. Environmental Protection Agency, and Dobbs v. Jackson Women’s Health Organization are a great beginning to re-establishing the boundaries between the three branches of government.
The Ruling of Biden v. Texas addresses Presidential Executive Orders, “I’ve got a pen and I’ve got a phone”. When Presidents issue Executive Orders they are creating laws which is the sole responsibility of Congress. If Congress cannot reach a consensus to write and pass legislation, it does not fall on the President to write and sign into “law” what Congress is unwilling to do.
This lack of consensus is why many Executive Orders are reversed by the next Presidential Administration. The border crisis was created by Congress failing to pass comprehensive immigration reform and exasperated by the Biden Administration.
New Mexicans have shared with me and the recent Gallup poll confirms not just New Mexicans, but a large majority of all Americans are concerned about immigration. Immigration should be a priority for the 118th Session of Congress.
West Virginia v. Environmental Protection Agency ruling addressed the lawlessness of the Federal Professional Class. These Federal professionals, create and enforce their regulations. Then judge and sentence those they find who violate their regulations. If this sounds unamerican, it is.
Congresses have been writing and passing a “framework for regulations” in the guise of law. The Affordable Care Act is an example of this, the ACA bill was 906 pages. The regulations for ACA were between 10,000 pages to 17,000 pages depending on who counts. The Federal Professionals have been performing the heavy lifting for Congress. The West Virginia v. EPA ruling draws the line that the Federal Professional Class cannot completely replace Congress and the Presidency.
The EPA department associated with the West Virginia v. EPA ruling should immediately be closed, and all federal funds supporting the effort returned to the Federal Treasury. The federal government should reimburse the American people for the cost they incurred associated with this illegal action by the Federal Professionals.
Dobbs v. Jackson Women’s Health Organization ruling is remarkable in that the Supreme Court self-limited its authority.
In 1962 the American Law Institute called for abortion to be legal with limits. In 1973 forty-six states introduced abortion reform legislation. States were coming together to balance the rights of mothers and the rights of their unborn babies. Then the Supreme Court with, Jane ROE, et al., Appellants, v. Henry WADE ruled on abortion reform. The Dobbs v. Jackson Women’s Health Organization ruling will once again place the responsibility on Congress and states legislators to make law. A recent Gallup poll shows that approximately eighty percent of Americans agree abortion should be legal and eighty percent agree on an exclusion in the third trimester. There is plenty of room for consensus for Congress and state legislatures to pass a law protecting the rights of mothers and the rights of their unborn babies.
When the branches of government go it alone and bypass the other branches they may realize short-term gains, but the country loses in the long-term. A country where it is governed in the short term cannot survive in the long-term.
My forty years of experience in negotiating multi-million-dollar contracts and contract disputes (private and government, national and international corporations) have taught me valuable lessons. Understand my and my opponent’s financial and emotional position. Establish a walk-away bottom line. A failed negotiation can always be reopened. A win is what you need, not what you want. A one-sided win creates an enemy for a lifetime.
Americans have elected individuals to Congress based solely on their ideology and then surprised with gridlock and hyper-partisanship. We see the members of Congress behave as if the opposing party are their enemies, not Americans with opposing views. This November, elect individuals to Congress and state legislators that have our shared core beliefs, demonstrated ability to build consensus, and are capable of conducting the people’s business.

On February 23, Mario Perez allegedly racing in excess of 100 mph on the streets of Albuquerque ran into the back wheel of a school bus. The school flipped with twenty-three students on board. Mario Perez was initially charged with just two counts of third-degree felonies for the two students that underwent surgery. In May the Grand Jury added 15 additional counts of child abuse.
